CDL Rights Management Framework

Step 2: Evaluate Rights Issues

About Rights Scenarios

An important tool for the analysis phase of any digital collection project is the creation of a "rights scenario." A scenario can help guide your staff in identifying areas where rights interplay with the creation or capture of the digital resources, and can help surface legal issues and provides guidance on data collection needs. Each scenario contains information organized in the following manner:

  • Introduction: sets the scene and gives background for the general scenario
  • Users and uses: describes potential uses and the communities that will use and have access to the resources
  • Characteristics (features): provides information about type of access that will be granted to the resource, copyright status of the resource, etc.
  • Possible problems
  • Legal issues
  • Data requirements issues
  • Records management issues
  • Privacy/confidentiality issues

Scenarios can build on other scenarios, and we recommend that where possible general case scenarios are created that can be adopted in part or in whole by subsequent projects. Our samples scenarios show a general scenario for the archiving of web sites, and particular scenarios that address issues for individual projects. Additional scenarios are forthcoming.
